The election of Musa Avia Aggah, a member of the Peoples Democratic Party (PDP), representing Bassa/Jos-North Federal Constituency in the House of Representatives has been nullified by a tribunal, sitting in High Court 4, Jos.
According to the court, Hon. Aggah was not validly nominated by the PDP for the bye-election conducted on February 26, 2022.
Musa Aggah was declared the winner of the Jos North/Bassa Federal constituency bye-election conducted on February 27, by the Independent National Electoral Commission (INEC).
Aggah had polled a total of 40,343 votes to win the election, closely followed by the People’s Redemption Party’s candidate, Mohammed Adams Gwani, who got 37,857 votes, while the ruling All Progressives Congress candidate, Joseph Abbey Aku, who came a distant 3rd, scored 26,111 votes.
The tribunal on Friday, in a consensus judgment led by its chairman, Justice Hope O. Ozoh, Khadi Usman Umar, and Justice Zainab M. Bashir, held that the petitioners have proved their case against Aggah beyond a reasonable doubt.
The court also said that Aggah did not score the highest valid votes in the election.
The court has ordered INEC to return Muhammad Adam Alkali of the Peoples Redemption Party (PRP) as the valid winner of the February 26, 2022 bye-election.
